Are Nicotine Pouches Legal In Poland?

Nicotine pouches are a relatively new arrival. That's one of the main reasons the EU hasn't created a set of regulations, leaving Poland to set their own.

Poland joined the EU in May 2004 and, at that time, agreed to follow EU regulations. However, when it comes to nicotine pouches, there have been no regulations issued.

In short, every country has to decide their own rules regarding nicotine pouches.

How Poland Stands On Nicotine Pouches

Nicotine pouches in Poland first appeared around 2020. As in many countries, they initially largely flew under the radar. This was certainly helped by the fact that they were a viable tobacco-free option for smokers.

However, as they became increasingly popular, there has been a call for regulations.

“At present, nicotine pouches in Poland are effectively legal as there are no regulations controlling the buying and selling of pouches.”

Right now, you can get some great deals on nicotine pouches online. Best of all, anyone can order as there are no age restrictions, no nicotine limits, and no packaging requirements.

To be honest, we’re not against a little regulation. It’s good to sell just to adults and to know the nicotine content of what you’re buying.

It appears the Polish government agrees, as it looks set to introduce some regulations.

Potential Polish Regulations

Poland has created draft regulations, which have already been submitted to the European Commission. This is an important part of the process and gives the commission three months to object to the proposed legislation.

Those three months have already passed, making it highly likely that the following will soon become law in Poland.

Age Limit

When the regulations become law, it will no longer be permissible to sell nicotine pouches to people under the age of 18. This is something that most countries have done.

Packaging

Nicotine pouches contain fewer health risks than cigarettes. However, that doesn’t stop governments from seeing them in the same way.

As such, all nicotine pouch cans sold in Poland will need a health warning on them. The exact wording has yet to be decided.

Purchasing Locations

Interestingly, Poland isn’t worried about the variety of nicotine pouch flavours. However, they do seem to be concerned with how people will get their pouches.

As such, they plan to ban the sale of nicotine pouches via the internet or from a vending machine.

This could make it harder for you to source your favourite nicotine pouches.

Nicotine Levels

Some of the strongest nicotine pouches can contain 40mg of nicotine or more.

That could be dangerous if accidentally used by someone without a nicotine tolerance.

To help reduce the risk, Poland will place a cap on the amount of nicotine allowed in a pouch. At present, it’s suggested this amount will be 20 mg.

Ingredients

Nicotine pouches shouldn’t contain carcinogenic substances. The new Polish regulations enforce this assumption, making sure all manufacturers adopt safe production processes.

Summing Up

Fortunately, none of these regulations will prevent the nicotine pouch industry from selling legal nicotine pouches.

However, it may be more difficult to get the pouch you like. We recommend you stock up now on your favourites while you can still order them online.

That will buy you time to decide how to purchase pouches, after the regulations are in force. Remember, we’re here to help in any way we can.
